What is certification
This responsible and exciting procedure for the employer and employee. For the employer it is an opportunity to objectively assess the compliance of employees in terms of staffing, to optimize the allocation of labor resources and to prepare based on it talent pool. For the plant's certification is an incentive to improve the quality and productivity of their work, professional development and the development of new modern methods and technologies.
Certification is a legal and objective criteria, providing possibility of termination of the employment contract with those employees who showed a low level of skills or their translation into other positions with salaries adequate to their level of knowledge. On the other hand, those workers who have shown themselves in a positive way, by results of certification can expect to pay increase and promotion through the ranks.
Categories of employees exempted from certification
There is no legal act containing the list of employees who are not subject to certification, so businesses and organizations are normative acts that define the list. In determining the number of employees who will be evaluated, it is necessary to consider the guarantees that the law establishes to protect the employee from unreasonable decisions.
For example, based on the provisions of article 70 of the labour code, establishing probationary periods, unconditional release from attestation is required for employees whose probation period is not over. In most cases, this exemption shall be those employees who worked after the conclusion of the employment contract less than 1 year. The list of persons who are not subject to certification are contained in the regulations On the procedure for certification of managerial, engineering and technical personnel and other specialists of enterprises and organizations of industry, construction, agriculture, transport and communications" in the wording dated 14.11.1986. Today it is the only normative act which shows such a list.
Under this Provision, not certified:
- young professionals who haven't ended the period of obligatory work after graduation;
- women who present a certificate of pregnancy;
- women with children under three years and those who have worked for at least 1year after holiday on care of the child;
- single parents with children under 14 or a disabled child who is under 18 years of age.
From certification generally may reject all categories of employees, the dismissal of which by the employer by law is not allowed.
