Instruction
1
Crossing the borders of Russia is regulated by Federal law No. 114 "On the procedure of exit from Russia and entry to Russia". The law clearly stipulates that minors have the right to leave Russia, accompanied by both parents, in the company of one parent, alone or with a third party (with the consent of the parents).
2
If a minor child is traveling with his mother, then to obtain the consent of the father is not required. It is necessary to consider the legislation of the country of destination. The consent may require for obtaining a visa and crossing the border of a foreign state. The consent may be inadequate, may request to provide a translation for the father's consent to travel on the language of the host state.
3
A father's consent to leave the child must be in writing and shall be notarized. The document should contain information about the host country, data on length of stay in the territory of a foreign state.
4
For registration of the father's consent to travel abroad for minor child notary is required: the passport of the father, the child, the accompanying person, birth certificate, information about the trip.
5
If the family is complete and all living together, registration of necessary documents for the trip is not problematic. As a rule, problems with registration of consent for travel of a child to occur in families where the parents are divorced.
6
If the father there is no objective reason for refusal of consent to travel abroad, and the failure to argue a bad attitude to the former spouse and the desire to "annoy", you can try to resolve the dispute in court.
7
Given that the child's personality nebezpecna, and the right to freedom of movement in the Russian Federation is enshrined in the Constitution, it is possible to speak about infringement of the rights of the child.
8
To begin writing, ask the former spouse to consent to the departure of the child abroad. Not having received the consent or written refusal, create a package of documents for a Schengen visa. To get out of Russia consent is not required, but it is necessary for obtaining a visa and entering the territory of the Schengen agreement.
9
Having received a refusal to issue a Schengen visa, in the absence of the package of documents a father's consent to leave the child, feel free to translate and adequately assure the document.
10
Write a statement to the court that the father of the child infringes on the rights of the latter, preventing its free movement. Apply refusal to issue a visa and proof that you approached him in writing. The process can involve the guardianship. The process requires a lot of time and effort, but the other way in this situation no.
11
You can, of course, travel to countries that do not require the authorization, but then the question arises, who will protect and defend the rights of the child, if not his mother.
