First of all, discuss this issue with your spouse, in order to continue to obtain documented consent to the adoption. It is necessary that this confirmation has been officially certified by a notary, either in the city or district office of the office for the custody of children. For adoption requires the consent of both parents of the child.

If the biological parent in the previous marriage was officially deprived of parental rights and the child right, then you can start to arrange the adoption procedure according to the law. If the biological parent is deprived of their rights, before making an adoption, you first have to achieve according to his abandonment of the child. Of course, to obtain such consent from the parent of a child is a daunting task. Try with your current spouse to give convincing arguments of the necessity of this step, and that your actions are for the best interests of the child and its future. Better and easier it will be to cope with further steps to adoption, if you reach agreement in this matter without going to court.

In case of failure of one of the parents to give you the right to adopt a child contact the court with the statement for deprivation of parental rights. The possibility to deprive a biological parent of his parental rights legally can be only in one case - if the parent is not systematically perform their duties, e.g. in case of malicious evasion from alimony payment. But the procedure of collecting evidence is rather complicated.

Please see the statement of claim in the municipal or district court at the place of registration of the child.
In the statement, specify the following information:
the circumstances and justification for the request for adoption of a child;
- information about the parents and the child: surname, name, patronymic and date of birth, information on place of residence (location);
- a request for a change (if necessary) last name and patronymic of the child claimed for adoption, entering the data of the adoptive parent as the parent in the entry on the birth of a child;
is one of the documents: the consent of the biological father/mother, certified by a notary or the court decision on deprivation of parental rights.

To yourself you must also have the following original documents:
- passports or other identity documents of the applicants;
- birth certificate of the child;
- certificate of marriage.

In the case of the court's positive decision, a district or a city registry office will issue a birth certificate with the new data already your child.
