Where to find the list of harmful conditions
To determine the occupations related to the harmful category, you should examine the RF Government Decree № 870 "On establishing a reduced working time, additional annual paid leave, higher wage workers employed in heavy works, works with harmful/dangerous and other special labour conditions".
To find a list of "bad" posts can be in collective agreements or branch agreements some companies.
This Resolution obliges the Ministry of health and social development to approve the list of positions, professions and industries that give employees the right to free treatment-and-prophylactic food, vitamins, an additional paid holiday and other appropriate measures required employees of hazardous occupations.
Adverse conditions in employment contracts
In the presence of harmful or dangerous working conditions, the employer is obliged to specify in the contract of employment information on job functions and work conditions, compensations and the terms of payment, bonuses, allowances and benefits. As employees of hazardous industries by law are not supposed to work more than 36 hours a week. Additional annual leave at the company's expense, in accordance with the terms of the employment contract, given to people working in the zone of radioactive contamination or in quarries/mines (underground and open pit mining).
Also the right to paid leave have employees whose work is associated with harmful physical, chemical or biological factors.
The resolution says that the minimum duration of the paid leave is calendar week. Usually it is employees who have worked in working in hazardous conditions at least eleven months. If the testing period less the period of leave granted accordingly fulfilled working time. At the same time paying out monetary compensation instead of using the additional leave is not practiced – such payments are possible only in the dismissal of the employee.
The only caveat in getting a paid vacation is the requirement for work experience in harmful working conditions, and seniority include only the time actually worked in these conditions.
