You can be transferred to a colony-settlement, if:— left 1/4 fixed by the court sentence in colony of General regime;— left 1/3 fixed by the court term of imprisonment in colony of strict regime;— the left 1/2 is established by court sentence (if it was previously released on PAROLE and subsequently convicted again);— left 2/3 of the statutory term of punishment for especially grave crimes.

Note: you are not transferred to the colony-settlement, if:— you can be recognised as especially dangerous recidivist;— you were given a sentence of life imprisonment which was later commuted to a fixed term set by the court;— you have not completed compulsory or special treatment in medical institution of a closed type;— if you do not give their consent to your transfer.

We first turn to the administration of IR with the transfer application you to light duty. The statement should write to the head of the colony, indicating its name and the rooms of the correctional facility. Specify your name and the date of the beginning and end of the sentence. Ask him to put you on light duty pursuant to article 120 of the penal enforcement code. Write a sentence you served for a total (strict) mode. Specify that you do not have penalties and violations (or they are repaid) and positively characterized by place of work (or work and study). Submit the petition for your translation on behalf of the immediate family, presentation of the foremen, masters, etc. Put the date and sign.

If IR administration moved you to light duty, the next step will be the drafting of a petition to the court at the place of punishment. The camp commander shall not refuse the transfer of your case to the courts if you have positive references.

Specify in the upper right corner of your petition, which court you send. Specify the article number under which you were convicted, your name and address IR. Ask the court about your transfer in a colony-settlement under article 78 of the penal enforcement code. Write that regret their actions, make every effort to ensure that this does not happen again. As evidence, enter the amount for the time spent in the colony of General or strict regime you had incentives, etc. date it and sign.

Pass the petition to the head of the camp and wait for the court decision. It is likely that it will be positive. Because the court will not consider when deciding:— the severity of your crime, you have claims (e.g., alimony);— the short duration of your stay in this correctional facility.
