Emerging conflict situations are resolved subject to labour agreement and the Labour code. Even if the contract was not concluded, the responsibility is with the seller not removed. The employee that caused the damage must compensate. But the obligation of reimbursement will only occur if the shortage occurred as a result of illegal actions, that is, if the employee has not performed or poorly performed their duties.

If the fact of the shortage is confirmed, the parties have the right to resolve the conflict voluntarily. That is, the seller either reimburse yourself or the employer deducts a specified amount of funds from employee wages. In some cases, the seller flatly refuses to admit his guilt, then the employer should submit a statement of claim in court about collecting of losses.

To the court to collect debts it is necessary to record the fact that inventory to identify the shortfall, then in writing ask the employee to reimburse the debt. If the employee does not agree, the employer must get the refusal in writing.

When filing a claim in court, you must provide the originals of letters between the employer and the seller, regardless of whether the letter of refusal or consent. If the employment contract is signed, the original should also be attached to the application. The documents proving the loss – inventory reports, primary accounting documents and, possibly, memoranda of other workers will be necessary for the court to clarify the circumstances.

The inventory procedure shall be executed in accordance with the rules, i.e., the presence of the order on the inventory is necessary. If the act is drafted incorrectly, the court may take into consideration of the misfiled documents or to find them invalid evidence.

The court thoroughly acquainted with all the circumstances of the case, will consider the submitted documents and adopt the decision on satisfaction of requirements of the employer, or refuse.

Note that the forced recovery of outstanding amount not exceeding the average monthly earnings of the seller is made by order, which must be issued no later than one month from the date of establishing the amount of damages.
