A citizen has a plot of land in the actual use, with the built on it house, provided that this section was received before prior to the entry into force of the Law USSR "On property in the USSR", has the right to place such a site in the property. This right is enshrined in the Federal Law "About introduction in action of the Land code of the Russian Federation".

A citizen who has a plot of land by right of permanent/perpetual use or lifetime inheritable possession, free can once get it into the property. It does not permit the levying of additional fees, in addition to statutory, i.e. it is free. This right is also those who have the right of permanent/perpetual use or lifetime inheritable possession of the building, structure or facility. In such cases, acquisition of ownership rights to under its permanent/perpetual use or lifetime inheritable possession of the land should apply on the acquisition of the right of ownership to the relevant state authority or local government together with the document confirming the fact of granting to the person the land (buildings) on the right of permanent/perpetual use or lifetime inheritable possession.

There are special categories of the citizens having the right to obtain land in ownership free of charge. Is veterans, disabled members of their families, military contractors, if they have served on the contract from 10 to 15 years (depending on the case). Such plots are provided for individual housing construction. Military personnel are also entitled to land for peasant/farmers. For individual housing construction also has the right to land, the employees of internal Affairs bodies, if they have served in bodies of internal Affairs for 15 years or more. Orphans and children left without parental care, have the right of ownership to land plots, previously given to their parents. All these norms are enshrined in certain laws dedicated to these categories of citizens, for example, in Federal law "On additional guarantees of social protection of orphans and children left without parental care", "On veterans" and others.
